Terms & Conditions
This is an English translation provided for your convenience. In the event of any discrepancy, the Dutch version is legally binding.
Article 1 – Identity of the company
Dulguun Otgonjav Interior Architect is a sole proprietorship established in Sint-Katelijne-Waver, Belgium. These terms and conditions apply to all services, quotations, agreements and invoices of Dulguun Otgonjav Interior Architect.
Article 2 – Applicability
These terms apply to all offers, quotations, agreements and services. By accepting a quotation, signing an agreement or paying a deposit, the client acknowledges having read and agreed to these terms. Deviations are only valid if expressly agreed in writing.
Article 3 – Description of services
Dulguun Otgonjav Interior Architect may provide, among others, the following services:
- Interior concept development and design
- Preparation of plans and visualisations
- Material and colour advice
- Design of bespoke furniture
- Guidance of interior projects
- Site supervision and project management
- Advice on layout, furnishing and finishing
The interior architect acts solely as designer, advisor and project coordinator. The execution of construction or renovation works is carried out by external contractors or suppliers.
Article 4 – Nature of the engagement
The services of Dulguun Otgonjav Interior Architect constitute a best-efforts obligation. The interior architect undertakes to carry out the assignment with care and professionalism. No guarantee is given of a specific result.
Article 5 – Quotations and formation of the agreement
All quotations are without obligation and valid for 30 days, unless stated otherwise. An agreement is formed when the client accepts the quotation in writing or has made a deposit payment. Changes to the original assignment may give rise to an adjustment of the fee.
Article 6 – Fees and pricing structure
Fees may be calculated on the basis of a fixed price per phase, an hourly rate, a percentage of the total project budget, or a combination thereof. All prices are in euro and exclusive of VAT, unless stated otherwise. Additional costs such as travel, printing, 3D visualisations and external studies may be charged separately.
Article 7 – Payment terms
Invoices are payable within the period stated on the invoice. In case of late payment, statutory interest and an administrative fee may be charged. The studio reserves the right to suspend services in the event of outstanding payments.
Article 8 – Obligations of the client
The client undertakes to provide all relevant information in good time, to communicate the available project budget clearly, to make decisions within a reasonable period, to grant access to the site, to pay invoices on time, and to contract and pay contractors and suppliers directly.
Article 9 – Contractors and suppliers
The interior architect may recommend contractors or suppliers, but the client remains free in the choice of executing parties. Dulguun Otgonjav Interior Architect cannot be held liable for execution errors, delays, price changes or defects caused by contractors or suppliers.
Article 10 – Planning and execution
Execution timelines are indicative. The interior architect cannot be held responsible for delays caused by contractors, design changes, late decisions by the client, supply problems or force majeure.
Article 11 – Site supervision and project management
If the assignment includes site supervision or project management, this task consists of coordinating and guiding the works. The interior architect does not carry out construction works and is not responsible for the technical execution by contractors. Remarks or recommendations are advisory in nature.
Article 12 – Liability
Dulguun Otgonjav Interior Architect can only be held liable for direct damage resulting from a proven fault in the execution of the assignment. Liability is in any case limited to the amount covered by the professional liability insurance. The interior architect is not liable for errors of contractors, indirect damage, or damage resulting from incorrect information provided by the client.
Article 13 – Intellectual property
All designs, plans, drawings, visualisations and concepts remain the exclusive intellectual property of Dulguun Otgonjav Interior Architect. The client is granted the right to use these documents solely for the specific project for which they were created. Copying, distribution or reuse without written permission is not permitted.
Article 14 – Use of visual material
Dulguun Otgonjav Interior Architect reserves the right to use photographs and visual material of completed projects for portfolio, website, social media and publications, unless the client expressly objects in writing.
Article 15 – Termination of the assignment
If the client terminates the assignment prematurely, Dulguun Otgonjav Interior Architect is entitled to payment for work already performed, reimbursement of costs incurred, and reasonable compensation for services already delivered.
Article 16 – Force majeure
In the event of force majeure, Dulguun Otgonjav Interior Architect cannot be held liable for the failure to perform, or delayed performance of, obligations. Force majeure includes, among other things, illness, pandemics, fire, strikes, supply problems and government measures.
Article 17 – Privacy and data processing
The client's personal data is processed in accordance with applicable privacy legislation (GDPR) and used solely for the execution of the agreement, invoicing and project-related communication.
Article 18 – Applicable law and competent court
All agreements with Dulguun Otgonjav Interior Architect are governed by Belgian law. Disputes fall under the jurisdiction of the courts of the judicial district where the company is established.
